Welcome to SellAIBots. These Terms of Service ("Terms") govern your access to and use of the SellAIBots platform, website, and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Services, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

SellAIBots provides a white-label AI chatbot platform that enables agencies and businesses to:

  • Create and deploy AI-powered chatbots
  • Manage customer conversations and leads
  • White-label the platform under their own brand
  • Resell chatbot services to end clients
  • Access analytics and reporting tools
  • Integrate with third-party services via APIs

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • One account per person or organization unless otherwise authorized
  • We reserve the right to refuse service or terminate accounts at our discretion

4. Acceptable Use

You agree NOT to use the Services to:

  • Violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of others
  • Transmit spam, malware, or other harmful content
  • Engage in fraudulent, deceptive, or misleading activities
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Services
  • Create chatbots that promote illegal activities, hate speech, or harmful content
  • Scrape, data mine, or reverse engineer the platform

5. Subscription and Billing

  • Subscription plans are billed on a monthly or annual basis
  • All fees are stated in US dollars and are non-refundable unless otherwise specified
  • You authorize us to charge your payment method for subscription fees
  • Subscription renewals are automatic unless cancelled before the renewal date
  • Usage-based charges (message credits) are billed in arrears
  • We may change pricing with at least 30 days notice
  • Failure to pay may result in service suspension or termination

6. Intellectual Property

  • SellAIBots owns all rights to the platform, software, and documentation
  • You retain ownership of content you create or upload
  • You grant us a license to use your content to provide the Services
  • White-label license rights are governed by our separate License Agreement
  • Feedback you provide may be used to improve the Services without compensation

7. Data and Privacy

Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect your data. By using the Services, you consent to our data practices as described in the Privacy Policy. You are responsible for ensuring your use of the Services complies with applicable data protection laws.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELLAIBOTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless SellAIBots, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from: your use of the Services; your violation of these Terms; your violation of any third-party rights; or content you create or distribute through the Services.

11. Termination

  • You may cancel your subscription at any time through your account settings
  • We may suspend or terminate your account for violation of these Terms
  • Upon termination, your right to use the Services ceases immediately
  • You may export your data within 30 days of termination
  • Certain provisions of these Terms survive termination

12. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Services with at least 30 days notice. Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
